The referral process

  1. Step 1

    Where from?

  2. Step 2

    Information is gathered to determine if s. 42(1) criteria (Care Act 2014) is met, which requires further enquiries to be made.

  3. Step 3

    If the decision is made that the concern needs to be investigated further then the Lead Agency for a s.42(2) safeguarding enquiry will be identified.

    Devon County Council will transfer to another partner agency as necessary.

     

  4. Step 4

    A s.42(2) is allocated to the identified Enquiry Lead, who will then allocate an Enquiry Worker.

    Mental capacity for safeguarding and Making Safeguarding Personal are considered.

  5. Step 5

    The Enquiry Worker applies the principles of safeguarding and ensures the objectives of an enquiry are met (Care and Support Statutory Guidance).

  6. Step 6

    The Enquiry Lead has the responsibility to quality assure the enquiry, safeguarding governance and records approval for closure.


Example service user journey

Safeguarding concern referral

  • Ambulance report that Pat was left lying on the floor for several hours.
  • There was unexplained bruising on Pat.
  • Photographic evidence was taken.

Planning meeting or phone call takes place

  • Information received from the Ambulance Service
  • Information received from the Accident and Emergency department
  • Relevant professionals are present at the meeting or in the call
  • Mental capacity assessment of Pat is carried out regarding safeguarding
  • Family or advocate for Pat are included as Pat lacks mental capacity
  • Consultation with all, including Pat, is carried
  • An Enquiry action plan is developed
  • A protection plal is developed

Review

  • A review of the enquiry action plan, and safety plan is carried out, with family, Pat and relevant professionals
  • Agreement is reached as to whether further safeguarding is required or not

Outcome

  • Evidence indicated that Pat was at home for long periods of time without support
  • There was no indication that harm was caused by the family
  • Care Act Assessment and electronic alert system is provided to Pat, to reduce further risk of harm
  • Family is supporting Pat with one visit per ay
  • Close episode
