Refusing a request

We aim to be as open and transparent as possible. However there may be occasions when we have to withhold information from disclosure under the Environmental Information Regulations (EIR) and Freedom of Information Act (FOIA).

We may only withhold information it holds from disclosure if we have a valid reason in law to do so. Usually this will be because an exception under the EIR applies or because an exemption applies under the FOIA. If an exemption or exception applies we will normally inform you of this fact, unless to do so would in itself reveal information that would otherwise be exempt.

These exemptions apply to Devon County Council and to our publication scheme which may therefore not include certain types of information because the application of these exemptions.

If we have applied an exception or exception in a response to your request, and you do not agree that we should have done so, you have the right to appeal our decision by making a complaint. Further details about how to make a complaint are available from our Complaints page.
