Application for Designation of Civil Enforcement Area for Moving Traffic Contraventions

Regulations came into force on 31 May 2022 that giving effect to the moving traffic enforcement powers under Part 6 of the Traffic Management Act 2004 (“the Part 6 powers”).
The County Council’s Cabinet committee gave their approval to submit an application for Moving Traffic Enforcement powers on the 9th November 2022 (Item 238, https://democracy.devon.gov.uk/ieListDocuments.aspx?CId=133&MId=4462&Ver=4)
A number of sites were proposed within that report and further investigation/consideration has led to some sites being dropped and other sites being identified these changes were agreed with the Director of Climate Change, Environment & Transport in consultation with the Cabinet Member for Highway Management. These changes were communicated to all Members on the 8th August 2023.
Subsequently the requirements set out by Department for Transport for local Authorities to undertake prior to application, including a 6 week public engagement process, have been completed.
During the public engagement exercise 992 responses were received, these have been summarised and discussed with Director of Climate Change, Environment & Transport in consultation with the Cabinet Member for Highway Management.
The Authority has consulted with the Chief Officer of the Police and have full support for the 8 sites included in this application.
An alternative option would be to not proceed with the application for powers, however this would not provide opportunity to improve traffic management in Devon and would not align with Cabinet resolution.
