What is a Permit Scheme?

A Permit Scheme gives Devon County Council (DCC) a way to manage street and roadworks activities on the public highway. Permit Schemes were introduced under Part 3 of the Traffic Management Act 2004 (TMA) as amended by the Deregulation Act 2015. They were introduced to enhance Local Highway Authorities (LHAs) ability to minimise disruption as a result of street and roadworks.

The DCC Permit Scheme is based on Part 3 of the TMA (Sections 32-39), the Traffic Management Permit Scheme (England) Regulations 2015, and has been developed in accordance with the Department for Transport (DfT) Statutory Guidance for Highway Permit Schemes (October 2015) and DfT advice note for Local Authorities development new or varying existing permit schemes (June 2016).

Works promoters will apply for permission to complete works on the public highway in advance – this is a ‘works permit’. Devon CC will be required to consider the permit and approve / reject or propose conditions and apply a relevant fee. All permits received where DCC do not respond will be deemed to be approved.
