Some conditions imposed on a planning permission require a further submission of details, also known as an Article 30 (Discharge of Condition) submission, before the development can begin.
The application form can be found on the Planning Portal. There is a fee for every application to discharge conditions, however, you can apply to discharge multiple conditions in one application, which can reduce costs.
The statutory period to discharge the condition(s) is eight weeks from the date on which all required information is received. If the information provided is not acceptable, you will be informed by the planning officer that further information is required. The officer has the right to refuse to discharge your condition(s) until such information is received.
If we do not receive the requested information within 28 days, the application will be cancelled and you will not receive a refund. You will need to reapply with a further application form, fee and relevant paperwork. Failure to discharge your condition(s) at the correct time could result in enforcement action being taken.
